"American Physicians and Surgeons (AAPS) Sues the FDA to End Its Arbitrary Restrictions on Hydroxychloroquine

Today, June 2, 2020, the Association of American Physicians & Surgeons (AAPS) filed a lawsuit, AAPS v. FDA, against the Food and Drug Administration to end its arbitrary interference with the use of hydroxychloroquine (HCQ), which President Trump and other world leaders have taken as a prophylaxis against COVID-19.

Two million doses of HCQ are being sent by the Trump Administration to Brazil to help medical workers there safeguard themselves against the spread of the virus. But at the same time the FDA continues to block Americans’ access to this medication.

HCQ has been approved as safe by the FDA for 65 years, and the CDC states on its website that “CDC has no limits on the use of hydroxychloroquine for the prevention of malaria.”

More than 150 million doses have been donated to the strategic national stockpile controlled by the federal government, but unjustified FDA restrictions limit its use to only hospitalized patients for whom a clinical study is unavailable. Hospitals are even returning HCQ to the stockpile because they are not able to use it effectively.
The Insidious Relationship between The U.S. Food and Drug Administration (FDA) and Big Pharma

    “It is shocking that medical workers in Brazil will have access to HCQ as a prophylaxis while Americans are blocked by the FDA from accessing the same medication for the same use,” observes AAPS Executive Director Jane Orient, M.D.

    “There is no legal or factual basis for the FDA to limit use of HCQ,” states AAPS General Counsel Andrew Schlafly. “The FDA’s restrictions on HCQ for Americans are completely indefensible in court.”

Many foreign nations, including China, India, South Korea, Costa Rica, United Arab Emirates, and Turkey, use HCQ for early treatment and prevention of COVID-19,  AAPS points out.

    “Entrenched, politically biased officials at the FDA should not be allowed to interfere with Americans’ right to access medication donated to the federal government for public use,” Schlafly says. “By preventing Americans’ use of HCQ as a prophylaxis, the FDA is infringing on First Amendment rights to attend religious services or participate in political events such as political conventions, town halls, and rallies in an important election year.”

    “FDA Commissioner Stephen Hahn states that the FDA does not interfere with physicians’ ability to prescribe HCQ, and yet at the same time the FDA denies access by millions of Americans to 150 million doses of it in the national stockpile,” Schlafly adds. “This irrational hoarding by government is an abuse of power.”

More Evidence Presented for Why Hydroxychloroquine Should be Made Available, in a New Court Filing by AAPS

This week the Association of American Physicians & Surgeons submitted additional evidence to a federal court for why interference with hydroxychloroquine (HCQ) should end by the Food & Drug Administration (FDA) and the Department of Health & Human Services (HHS), in AAPS v. FDA, No. 1:20-cv-00493-RJJ-SJB (W.D. Mich.).

“As confirmed by another recent study of thousands of patients at the Henry Ford Health System in Michigan, HCQ is both very safe and highly effective in treating COVID-19, reducing mortality by 50%,” AAPS informed the court in its filing. “Countries with underdeveloped health care systems are using HCQ early and attaining far lower mortality than in the United States, where [HHS and the FDA] impede access to HCQ.”

Yet most Americans are still unable to obtain HCQ for early treatment of COVID-19, and virtually no Americans are able to access it as preventive medicine. HCQ has been used safely for decades by travelers to protect against malaria, but Americans are dying from COVID-19 while HCQ is withheld from them.

“Citizens of the Philippines, Poland, Israel, and Turkey all have greater access to HCQ than American citizens do,” observes AAPS General Counsel Andrew Schlafly. “In Venezuela, HCQ is available over the counter without a prescription, while in the United States pharmacists are prevented from filling prescriptions for HCQ.”

AAPS rebuts arguments presented by the FDA, which implied that medications are approved as safe only for certain conditions. In fact, HCQ and most medications have been approved without limitation, such that physicians can prescribe them for any off-label use.

“The mortality rate from COVID-19 in countries that allow access to HCQ is only one-tenth the mortality rate in countries where there is interference with this medication, such as the United States,” explains Andrew Schlafly.


Polish chemists have even showed the world how to synthesize HCQ from cheaply, widely available ingredients. The cost of this medication is less than a dollar a dose, in contrast with the very expensive alternatives being pushed by FDA officials.

In its filing, the FDA insisted that the public has no right to access nearly 100 million doses of HCQ which were donated to the Strategic National Stockpile. HHS is having that medication waste away while Americans are dying from COVID-19.

“In some areas of Central America, officials are even going door to door to distribute HCQ,” Andrew Schlafly adds. “These countries have been successful in limiting the mortality from COVID-19 to only a fraction of what it is in wealthier countries.”

AAPS filed this lawsuit to obtain legal redress in support of Trump, by ending the obstruction by the FDA of his policies that would save lives. AAPS has represented physicians of all specialties in all states since 1943. The AAPS motto is omnia pro aegroto, meaning everything for the patient.

Preliminary Injunction Sought to Release Hydroxychloroquine to the Public

Today the Association of American Physicians & Surgeons filed its motion for a preliminary injunction to compel release to the public of hydroxychloroquine by the Food & Drug Administration (FDA) and the Department of Health & Human Services (HHS), in AAPS v. HHS, No. 1:20-cv-00493-RJJ-SJB (W.D. Mich.). Nearly 100 million doses of hydroxychloroquine (HCQ) were donated to these agencies, and yet they have not released virtually any of it to the public.

Millions of Americans fear attending political gatherings, religious services, and even large family get-togethers without the availability of early treatment if they were to contract COVID-19. Why should Americans have to wait until they or a loved one is on a ventilator before they gain access to medication to overcome this virus?

(Let alone that HCQ cannot do nearly as much for them if anything at all, in a hospital inpatient setting, particularly after the "cytokine storm" has taken hold.)

“Why does the government continue to withhold more than 60 million doses of HCQ from the public?” asks Jane Orient, M.D., the Executive Director of AAPS. “This potentially life-saving medication is wasting away in government warehouses while Americans are dying from COVID-19.”

Today AAPS files its motion for a preliminary injunction to compel the government to release HCQ from its stockpile to the public, which could then immediately benefit from it. Reports of an uptick in COVID-19 in Arizona and elsewhere could then be handled without irrational, unjustified limitations on this medication imposed by the FDA.

AAPS agrees with President Trump’s adviser Peter Navarro, Ph.D., who decries the obstruction by officials within the FDA to making this medication available to the public. President Trump himself has successfully taken this medication as a preventative measure, so why can’t ordinary Americans?

“A perfect storm of politics in this presidential election year, along with conflicts of interest at the Defendant federal agencies, has resulted in unjustified obstacles to access to HCQ, an inexpensive medication having a track record of more than 75 years of safety,” AAPS writes in its brief being filed today in federal court.

AAPS files with the court a chart showing how countries that encourage HCQ use, such as South Korea, India, Turkey, Russia, and Israel, have been far more successful in combatting COVID-19 than countries that have banned or discouraged early HCQ use, as the FDA has. Last week the FDA even misled the public by falsely stating that HCQ should not be used to treat COVID-19, when multiple studies show its benefits, and thousands of patients have been successfully treated worldwide.

“The interference with public access to hydroxychloroquine is disrupting our political processes,” notes AAPS General Counsel Andrew Schlafly. “Perhaps that is what some want, in order to deter Americans from attending political conventions and even voting, but it is unconstitutional for the FDA to infringe on these constitutional rights by blocking access to this safe medication.”
