It appears that a federal agency must propose data changes to the federal register-- they did not do this, therefore, there was no opportunity for public comment. Henele states "they acted unilaterally, and that's not how it's supposed to work"

What was reported on August 23 was 161,392 fatalities caused by COVID-19 …
Had we used the 2003 guidelines, our estimates are that we would have roughly 9,684 total fatalities due to COVID-19. That’s a significant difference. That’s a difference on the scale of as much as 96%. The range that we calculated was 88.9% to 96% inflation.”
